In Bihar, marriages are registered under the Hindu Marriage Act or Special Marriage Act, and under the state’s marriage registration rules, through two separate offices: the Registration Department for a Hindu Marriage Act or Special Marriage Act registration, and, under the Bihar Marriage Registration Rules 2006, the Mukhia or Ward Commissioner for the place where the wedding was held. You provide age and address proof, photographs, proof of the wedding (for a Hindu marriage) and witnesses. A Hindu marriage registers quickly; a Special Marriage Act marriage needs the 30-day notice.

Note: This is general guidance for 2026, not legal advice. Marriage law in India is governed by central Acts but administered state by state, so forms, fees and timelines vary. Always confirm the current process on the official state portal or with your local Sub-Registrar or Marriage Officer, and consult a lawyer for your specific situation.

Where to register in Bihar

Bihar registers marriages through its Registration Department, under the central Hindu Marriage Act and Special Marriage Act and the state’s marriage registration rules, with the Registrar or Sub-Registrar for the area handling verification and parts of the process available through the state’s online services. Under rule 5 of the 2006 Rules the application goes to the Marriage Registrar with jurisdiction over the place where the marriage was solemnised, which is the Mukhia of that Gram Panchayat or the Ward Commissioner of that urban body. See the pillar overview at marriage registration in India.

The process step by step

  1. Identify the Act: Hindu Marriage Act registration for a Hindu, Buddhist, Jain or Sikh wedding already solemnised, or the Special Marriage Act 1954 for a civil or inter-faith marriage.
  2. Apply either to the Registration Department through its e-registration portal, or, under the 2006 Rules, to the Mukhia or Ward Commissioner for the place where the wedding was held.
  3. Submit documents and photographs and pay the fee.
  4. Attend with witnesses for verification; for a Special Marriage Act marriage, solemnisation follows the 30-day notice.
  5. Collect the marriage certificate.

Documents required in Bihar

Age proof (passport, birth certificate or 10th-standard marksheet), address proof, identity proof, passport-size photographs, an affidavit, and witnesses with ID. A Hindu marriage adds the wedding invitation and a priest certificate; a Special Marriage Act marriage adds proof of 30-day residence and the notice. Our documents required for marriage registration guide has the full checklist; confirm the current Bihar list with the registration office.

Fees, timelines and online support

Fees are modest and set by the state. A Hindu marriage registration is usually completed within a few days of verification; a Special Marriage Act marriage takes at least 30 days because of the notice. Bihar provides online citizen services for many processes, and you attend the office for verification, as covered in our marriage registration online guide. Confirm the current fee and process with the local Registrar.

Patna and district notes

Patna and the larger districts have registry offices for a central Act registration, and every panchayat and ward has a Marriage Registrar under the 2006 Rules, so work out which of the two you are dealing with before you travel. Bihar sees a large share of weddings in the auspicious months, so appointment slots fill quickly around peak dates; applying soon after the wedding, rather than leaving it for months, avoids both the queue and any question later when you need the certificate at short notice. Couples with family spread across states should note that Bihar’s own rules follow the wedding rather than the couple; our marriage registration in Uttar Pradesh guide covers the neighbouring position, which was tightened in 2025.

Reasons applications get delayed in Bihar

The common causes are name or date mismatches across documents, address proof in an old address, a missing ceremony proof for a Hindu marriage, witnesses without ID, and applying to the wrong office. Reconcile documents first and confirm the correct Registrar or Sub-Registrar office before you apply.

After you register

Use the certificate for visas, the spouse’s passport, joint accounts and a name change after marriage if you choose, and request certified copies. NRIs should also read our NRI marriage registration and apostille for a marriage certificate guides, and our marriage certificate in India guide covers the certificate’s uses. For inter-faith couples, see inter-caste and inter-religion marriage.

Registering in Bihar when the wedding was at the family village

A very large share of Bihar weddings are solemnised at the bride’s family home in a
village or small town while one or both spouses actually live and work in Patna, Delhi or
the Gulf. That creates the single most common Bihar registration question: which office.

Under the 2006 Rules the answer is settled by the wedding, not by the couple. Rule 5 sends
the application to the Marriage Registrar with jurisdiction over the place where the marriage was
solemnised, and rule 2 makes that officer the Mukhia of the Gram Panchayat or the Ward
Commissioner of the urban local body. A village wedding is therefore registered in that village,
even if neither of you has lived there for years and both of you now work in Patna or Dubai. One
witness from each side signs the application with you.

That is worth planning around rather than discovering afterwards. If the wedding is at the
bride’s family home, the form is easiest to complete in the days when everyone is still there and
the witnesses have not yet dispersed.

For couples abroad, read NRI marriage registration
before you fix dates, because the appointment usually requires both parties present.

What the 2006 Rules actually require

Bihar framed the Bihar Marriage Registration Rules, 2006 to comply with the Supreme Court’s
February 2006 direction that every state make marriage registration compulsory. They are short,
and they put the job somewhere most couples do not expect: the elected head of the panchayat or
ward where the wedding happened.

RuleWhat it saysWhat it means for you
2(ii)The Marriage Registrar is the Mukhia of a Gram Panchayat, or the Ward Commissioner or Councillor of an urban local body, for marriages solemnised in his jurisdictionYou are dealing with an elected local representative, not a registry clerk
2(iv) and 2(v)The Sub-Registrar is the Marriage Deputy Registrar General and the Collector is the Marriage Registrar GeneralThe escalation path is already built in above the Mukhia
3Every couple must register within 30 days of the wedding, and a late filing is still accepted on payment of the prescribed penaltyMissing the window does not close the door
5(1)The application is filed in triplicate before the Registrar with jurisdiction over the place of solemnisation, signed by both of you and by one witness from each sideThe wedding venue fixes the office, and you need two witnesses in total, not four
5(1) provisoThe Registrar may appoint the caretaker of a community marriage place as a Marriage Reporter to receive applications from couples married on those premisesA hall, hotel or temple can be authorised to take the form on the day
5(2)A declaration made before a Marriage Reporter counts as if it had been made before the Registrar himselfSigning at the venue is not a lesser version of signing at the office
4Registration is rebuttable proof that the marriage took place, not conclusive proof of its validityThe certificate evidences the wedding; validity still turns on your personal law
5(5), 6 and 7An objection is recorded and referred up to the Marriage Deputy Registrar General, who hears you and your witnesses, and an appeal lies to the CollectorThere is a defined route if the Registrar hesitates

The community marriage place clause, and why it is useful

The proviso to rule 5(1) is the most practical thing in these Rules and almost nobody uses it.
It lets the Marriage Registrar appoint the manager or caretaker of a community marriage place,
which the Rules define to include community halls, clubs, hotels, public places, temples and
churches, as a Marriage Reporter who can receive the application from couples married on those
premises. Rule 5(2) then treats the declaration and signatures made in front of that person as if
they had been made in front of the Registrar. If you are marrying at a venue that has been
appointed, the paperwork can be signed while the family is still assembled. Ask the venue whether
it holds that appointment when you book, the same way you would ask about a generator or a
licence, and if it does not, plan a counter visit instead.

Frequently Asked Questions

How do I register a marriage in Bihar?

Under the Bihar Marriage Registration Rules 2006, sign the application with one witness from each side and file it with the Marriage Registrar for the place where the wedding was held, which is the Mukhia or the Ward Commissioner, within 30 days. A Hindu Marriage Act or Special Marriage Act registration is a separate filing with the Registration Department.

Which department registers marriages in Bihar?

Two layers. The Prohibition, Excise and Registration Department handles Hindu Marriage Act and Special Marriage Act registration through its registry offices and its e-registration portal. The compulsory registration introduced by the Bihar Marriage Registration Rules 2006 runs through panchayats and urban local bodies, with the Sub-Registrar and the Collector above them.

How long does marriage registration take in Patna?

A Hindu Marriage Act registration is usually a few days after verification; a Special Marriage Act marriage takes at least 30 days because of the notice period.

What documents are needed to register a marriage in Bihar?

Age proof, address proof, identity proof, photographs, an affidavit and witnesses. A Hindu marriage adds the invitation and priest certificate; a Special Marriage Act marriage adds proof of 30-day residence.

Can I register my marriage online in Bihar?

Parts of the process are available through the state’s online citizen services; verification is before the Registrar or Sub-Registrar. Confirm the current steps with the registration office.

Which law governs marriage registration in Bihar?

The central Hindu Marriage Act and Special Marriage Act, applied through the state Registration Department and Bihar’s marriage registration rules.

Who is the Marriage Registrar in Bihar?

Under the Bihar Marriage Registration Rules, 2006 it is the Mukhia of the Gram Panchayat, or the Ward Commissioner or Councillor of the urban local body, for the area where the marriage was solemnised. The Sub-Registrar sits above that officer as Marriage Deputy Registrar General and the Collector as Marriage Registrar General. A Hindu Marriage Act or Special Marriage Act registration is handled separately by the Registration Department.

We married in a village but live in Patna. Which office takes the application?

The one for the village. Rule 5 of the 2006 Rules gives jurisdiction to the Marriage Registrar for the place where the marriage was solemnised, so a Patna address does not move the filing. Sign the application with one witness from each side while the family is still together, and ask whether the venue holds a Marriage Reporter appointment, which lets the form be completed on the premises.
